City to ban e-smoke in public venues

SHENZHEN will likely ban the use of e-cigarettes in public places and expand the scope of nonsmoking areas after a draft amendment to the tobacco control regulations is passed by the city’s legislature, according to the Shenzhen Special Zone Daily.

The newspaper said in a report yesterday that an increasing number of young smokers have been found using e-cigarettes. However, research has shown that some e-cigarettes are even more harmful to health than traditional cigarettes.

Currently, 42 countries and regions worldwide have banned or restricted the use of e-cigarettes in public places, the Daily report said.

The draft amendment clearly specifies that using e-cigarettes is considered smoking. In the future, Shenzhen will ban not only tobacco products and traditional cigarettes in nonsmoking places, but also e-cigarettes.

The draft amendment also moderately expands the scope of nonsmoking areas, which include outdoor platforms and waiting areas for public transport, and outdoor ticket-purchasing areas and waiting areas outside the entrances and exits of stadiums.

Smoking will be prohibited within five meters of the entrances and exits of public transport stations and buildings.

According to the current tobacco control regulations, those who smoke in nonsmoking areas in disregard of dissuasion will be fined 50 yuan (US$7.43) to 500 yuan. The draft amendment stipulates that law enforcement officers can impose a fine of 50 yuan on smokers caught smoking in nonsmoking areas without warning.

It is also specified that penalties can be imposed directly on venue operators if smoking is found at the venues. The operator fine ranges from 1,000 yuan to 30,000 yuan, depending on the seriousness of the situation.

In order to better protect minors from the impact of tobacco products, the amendment specifically stipulates that tobacco products shall not be sold within a radius of 100 meters of kindergartens, primary and secondary schools, children’s palaces and children’s activity centers, or the violators will face a fine of 30,000 yuan.

The punishment on tobacco sellers who fail to put up warning signs have also been intensified, according to the draft amendment. Violators will face a fine of 1,000 yuan for their first violation and 5,000 yuan for a second violation. Those who hinder law enforcement will be fined 10,000 yuan. (Zhang Yu)
