Illegal structures at golf course in Bao’an to be dismantled

THE Greenbay Golf Club in Bao’an District will be demolished as it illegally occupies State-owned land, the Shenzhen Economic Daily reported yesterday.

According to the city’s planning and land supervision bureau, the Greenbay Golf Club has illegally occupied 671,232 square meters of State-owned land.

Eleven structures on the golf club, which includes an 18-hole golf course and a number of clubhouses with an overall floorage of 27,709 square meters, haven’t obtained legal certificates.

On June 3, 2015, the bureau imposed administrative penalties on Shenzhen Greenbay Golf Club Co. Ltd. for illegal land use and construction, and ordered the company to return the illegally occupied land as well as to demolish all buildings at the club within 30 days from the date of receiving the decision letter.

The company applied to the municipal land authority for administrative reconsideration, while the latter maintained the decision on administrative penalty.

In 2015 and 2016, the company successively filed an administrative litigation to Bao’an District People’s Court and Shenzhen Intermediate People’s Court, but both courts dismissed the case on the grounds of the justifiability of the penalty.

In 2017, the company again applied to the provincial higher people’s court for retrial, but was rejected in November 2018.

In April and October of 2018, the district’s land authority issued two separate notifications and put up relevant notices at the club, requiring the relevant individuals to move out as soon as possible. In April 2019, Bao’an District People’s Court posted a notice in a prominent position at the golf club, ordering the company to withdraw from the land by May 12, 2019.

The land will be used as green space after it is recovered, the Daily report said. (Zhang Yu)
