Measures released to facilitate dispute resolution

BAO’AN District recently rolled out 23 specific measures to deepen dispute mediation in multiple ways, in a bid to blaze new trails for social governance.

The measures mainly focus on six aspects, namely, people’s mediation, administrative mediation, judicial mediation, litigation and mediation, a reward and punishment mechanism, and organizational guarantee.

According to the measures, Bao’an District will further motivate full-time mediators, community lawyers and psychologists to participate in dispute mediation, as they are required to partake in mediation in no less than 30 percent of the total number of disputes in that month.

The district encourages the establishment of industrial and professional mediation organizations and a pool of mediation experts at the district and subdistrict levels. Meanwhile, at least one personal mediation studio will be set up in each subdistrict by the end of the year.

Bao’an will also set up administrative mediation committees in 10 pilot units, such as the district’s human resources bureau, housing bureau and health bureau.

According to the measures, administrative mediation should be organized in accordance with the law before decisions are made on adjudication and administrative reconsideration. Before the execution of the arbitration results, the functional departments shall organize administrative mediation again in due time according to the wishes of the parties concerned.

It is also proposed that the district’s procuratorate take the lead in organizing relevant departments to conduct mediation in cross-department dispute cases. If the mediation fails, the case shall be handled according to the procedure of an appeal.

In order to ensure people feel they are treated fairly and justly in every judicial case, Bao’an will build a one-stop legal service center and a dispute resolution center.

The district will also open a green channel for mediation organizations that have registered with the district’s justice bureau.

The district’s court shall arrange a specially assigned person for the cases that apply for judicial confirmation, and examine and confirm the cases within 15 days. Priority will be given to major sensitive cases to ensure they are handled within five days.  (Zhang Yu)
