Court issues ¥10.42m fine for IP case

LONGGANG District People’s Court recently issued a fine of 10.42 million yuan (US$1.47 million), said to be the court’s highest so far, for an intellectual property (IP) case where a Chinese company was reported for manufacturing fake iPads and selling them to foreign markets and domestic online platforms like JD.com.

The company earned more than 20 million yuan from the illicit business. The collegial panel of the Longgang court confirmed that the behaviors of three members of the company constituted the crime of counterfeiting a registered trademark.

The key person at the company, surnamed Yu, was also sentenced to four years and six months in jail, according to sznews.com.

The Longgang court has been praised by Apple Computer Trading (Shanghai) Co. for the trial.

Another judgment on a similar case was made at the Longgang court simultaneously, in which the defendant, surnamed Tian, and another five were found guilty of producing fake Huawei laptops and earning more than 16 million yuan in illegal income.

Tian was sentenced to four years and six months in prison and fined 8 million yuan.

As of Aug. 20, the Longgang court had handled 75 cases related to the infringement of intellectual property rights.

Criminals with a record of violating IP rights are believed to be likely to repeat the crime, because they have fixed customers and are familiar with the industry’s procedures.

In order to strengthen deterrence and deprive criminals of advantageous conditions, the Longgang court levies high fines when dealing with IP cases.
