Traffic police deny rumors about new regulations on DUI

SHENZHEN traffic police denied the widely spread rumors about new regulations on driving under the influence (DUI), stating that drunk driving at a parking lot is regarded as DUI, Shenzhen Special Zone Daily reported Friday.

The online rumors exclude three types of behavior from the scope of DUI, namely drunk driving in an emergency, drunk drivers’ starting a vehicle while resting in it and driving while intoxicated in a residential parking lot. The city’s traffic police declared that those new regulations are false.

Operating a vehicle by drunk drivers, such as starting the car and releasing the handbrake, comes with punishment. Also, drunk driving in a parking lot is deemed as DUI. According to the road traffic safety law, public parking lots belong to the definition of “road.”

Recently, traffic police handled a relevant case. Very early Wednesday, they received a traffic accident report of a car that crashed onto a concrete column in a parking lot in Xixiang, Bao’an District. The police suspected the driver, surnamed Qiao, of drunk driving at the scene. However, it was Qiao himself who called the police.

A surveillance video retrieved by the police showed that Qiao was driven back to the parking lot by a designated driver at

11:16 p.m. Tuesday. The driver failed to wake Qiao up and then left the parking lot. Not long after that, Qiao staggered out of the car and even fell on the ground. After looking around, Qiao went back in the car and started it.

Qiao said he attempted to move the car to the spot where he usually parked. The right side of the vehicle crashed onto a parking column during a right turn. He thought the designated driver caused the scrapes, so he called the police and informed the driver. At present, compulsory criminal measures have been taken against Qiao.
