Firm contacts court to solve wage arrears

THE legal representative of a company, who had been listed as untrustworthy, recently took the initiative to contact Longhua District People’s Court in a bid to pay the outstanding wages that the company had owed to three employees for five years, Shenzhen Evening News reported.

Following mediation presided over by the judge, the three employees finally agreed on a settlement. Prompt payments were made after the cases were solved.

The company’s three former employees, surnamed Feng, Tang and Yang respectively, brought the company to court for wage arrears after a labor arbitration in 2016, the News report said.

The court ordered the company to pay 1,500 yuan (US$232), 3,435 yuan and 4,639 yuan to the three employees respectively. However, the company failed to fulfill its obligations.

In 2017, the three employees applied to the court for compulsory execution. Unfortunately, when court staff arrived at the company, the company had been emptied out. Moreover, the company’s assets couldn’t be found.

The court restricted the company and its legal representative for high consumption and included its legal representative in the default list.

In accordance with the law, the court ruled to terminate the execution procedure and informed the applicants that they could apply to the court at any time if they had any clues related to the company’s assets.

Recently, the company’s legal representative contacted the court voluntarily, hoping to fulfill the company’s obligations and pay the back wages. The legal representative said that the company contacted the three employees multiple times, but they already left Shenzhen and refused to apply to the court to rescind the punishments.

Due to the restriction of high consumption and inclusion in the default list, the firm had been unable to operate normally.

The three employees finally agreed to a settlement with the company after talking with the court’s judges. The legal representative apologized on site and promised that the company will obey the law and treat employees fairly in the future.
