Lawsuit over baby’s death

A THREE-YEAR lawsuit is still going on between a family and a hospital in Shenzhen over the death of a baby.

In 2014, Wang Yanju, wife of Zhang Yang, delivered a baby at a local hospital. The baby had only survived three days before he was found to have breathing difficulty and later died at the hospital.

The family took the hospital to Futian District People’s Court in August 2014 over the hospital’s incompetence in treating the newborn. The court had held four hearings by March 2017, and recently ordered a review of a third-party appraisal report offered by the family, which was not recognized by the hospital. The report concluded that the baby had died of sudden death.

The hospital claimed the baby had died of respiratory system failure while under the care of the parents. However, the family has argued that the hospital failed to treat the baby when it was in critical condition. The family even questioned whether the oxygen deficiency the baby suffered from during delivery, which was allegedly caused by improper treatment by the hospital, was another factor in the baby’s death.

The Futian court has yet to hand down its ruling.
