Injured dancing student seeks compensation over fracture
    2019-06-28  08:53    Shenzhen Daily

A WOMAN has demanded compensation from a dancing teacher with an adult dancing studio in Longhua District who is accused of breaking the woman’s collarbone during a class last week, SZTV reported.

The teacher, surnamed Yang, also allegedly asked his student, surnamed Ding, to lie about her fracture when applying for her medical expenses to be covered by insurance.

Ding said that during a warming-up exercise at her fifth classical dancing lesson June 19, Yang helped with stretching her shoulders and did not stop when Ding indicated that she was in pain, which led to a collarbone fracture.

Color ultrasonic diagnosis and X-ray examination show a clear fracture on Ding’s right collarbone. Doctors placed a steel plate in her shoulder and said that it can only be removed after another operation a year later.

Ding said that Yang’s response to her demand for compensation was ambiguous. When Yang suggested that Ding tell the insurance agency that Ding herself was responsible for the fracture, Ding refused, which seemed to have angered Yang, Ding said.

During an interview with SZTV, Yang admitted that Ding was injured during the dancing class. He repeatedly said the matter should be settled through legal means and declined to comment on asking Ding to lie about her medical insurance.

Qi Yanbing, a lawyer, said that judging from what he had learned, Yang is obviously suspected of negligence at work and should therefore cover Ding’s medical expenses.

Qi also pointed out that if Ding were to have claimed that she caused the fracture herself, it would have constituted insurance fraud, and Ding would have had to bear legal responsibility for it.(Liu Wenjin)
