Customs impounds 21.4M IPR infringement items

SHENZHEN Customs impounded more than 21.4 million items in over 9,900 batches that were suspected of infringing the intellectual property rights (IPRs) of the proprietors in 2021.

In 2021, customs implemented 12,000 items of protection measures over 1,431 IPR matters of 452 enterprises from 27 countries and regions, data released by the customs authority showed Friday, days ahead of the 22nd World Intellectual Property Day that falls on today.

Customs also released 10 typical cases regarding IRR protection and fight against IPR infringements. The cases included exporting power inverters that infringed on Huawei Technologies’ invention patents, exporting oxford fabric that infringed the International Olympic Committee’s trademark and exporting products that infringed luxury brands’ rights.

On April 7, a company in the city of Maanshan in Jiangsu Province declared to customs to export mobile phones to Hong Kong via Shenzhen Bay Checkpoint. Among the exported goods, 10,560 boxes with a market value of 158,400 yuan (US$24,363) were printed with the TECNO trademark. The proprietor confirmed the products had infringed their trademark. Customs impounded the products and fined the exporter.

Since 2021, Shenzhen Customs has seized 554,000 items that infringed proprietors’ rights by cross-border e-commerce enterprises which exported products through land checkpoints to Hong Kong from Shenzhen.

In July, Shekou Customs seized a batch of oxford fabric printed with the Olympics logo on it. The fabric, 109,400 meters long, was loaded in three TEUs (twenty-foot equivalent units) and was confirmed to have infringed the International Olympic Committee’s trademark. According to customs, trademark infringements took up the majority of IPR violations.
